Court orders man to properly seek lover’s hand in marriage

In her submission, the complaint told the court that she was a divorcee and prayed the court to confirm her right to choose a spouse.

A Shari’a Court sitting at Magajin Gari, Kaduna, has ordered one Aminu Saminu to properly seek the hand of his lover, Aisha Zubairu, in marriage from her father.

The judge, Kabir Muhammad, gave the ruling on Tuesday after Mr Zubairu filed a suit against her father for refusing to allow her to marry her lover.

According to the judge, such is in line with established Islamic law.

Earlier during the first mention of the case on January 14, he had ordered that the complaint’s father, Zubairu Surajo, must be present in court at the next adjourned date.

However, Surajo and his counsel, Nasiru Abdullahi, who represented him during the first sitting, were not in court.

The court said, “Saminu should go with his parents to Zubairu’s house and properly seek for her hand in marriage. If he agrees, fine, but if he doesn’t, you should return to court in two weeks.’’


The complainant’s father refused to allow his daughter to marry the man of her choice because of an old misunderstanding between their two families.

In her submission, the complaint told the court that she was a divorcee and prayed the court to confirm her right to choose a spouse.

“Saminu and I had been lovers before my forced marriage to my former husband by my father. Now, my father says I can marry any other person, but not Saminu. He even threatens to seek legal action against any of his relations who will defy his order and try to marry me off,” she told the court.

However, in his defence, Mr Surajo, through his counsel, submitted that his refusal of his daughter’s marriage to Mr Saminu was due to a past act of disrespect to his family by Mr Saminu’s parents.

He argued that Mr Saminu’s parents did not properly seek the complaint’s hand in marriage, in accordance with established Islamic law.
