Appeal Court affirms Ademola Adeleke as Osun governor

Governor Ademola Adeleke has been affirmed as the winner of Osun governorship election.
The court also awarded N500,00 in fines against Gboyega Oyetola and the All Progressives Congress.
The judgment was given by a three-member panel of justices led by Mohammed Shuaibu.
Following a case submitted by the defeated ex-governor, Mr Oyetola, the Elections Petition Tribunal nullified Mr Adeleke’s victory and ordered him to return the Certificate of Return issued to him by the Independent National Electoral Commission (INEC).
Mr Oyetola had predicated his petition on the allegation of over-voting in some polling units and clamoured that Mr Adeleke’s victory be upturned.
But in Mr Shuaibu’s judgment delivered on Friday, the appellate Court ruled that the 1st and 2nd respondents, Mr Oyetola and the APC, had failed to substantiate their claims with proof.
In a similar cross-appeal where Mr Oyetola alleged Mr Adeleke tendered forged certificates to INEC, Justice Ifeoma Jombo-Ofo ruled the claim “meritless” as the appellants failed to prove beyond reasonable doubt that the Mr Adeleke’s school credentials were falsified.
Ms Jombo-Ofo also added that Mr Oyetola and the APC had lost any rights to reopen the forgery case.
Mr Adeleke polled 403,371 votes to unseat Mr Oyetola, who scored 375,027 votes in the July 16, 2022, election.
