Court remands man over alleged unlawful gun possession

The police prosecutor said that the defendant was in possession of the gun without justification.

An Iyaganku Magistrates’ Court in Ibadan, Oyo State, on Thursday, ordered the remand of one Rafiu Kabiru, 48, arrested for allegedly being in unlawful possession of a gun.

Mr Kabiru, whose address was not provided, is facing a one-count charge of unlawful possession of a gun.

The Magistrate, Olasinmibo Sanusi-Zubair, who did not take the plea of the defendant for want of jurisdiction, ordered his remand in the correctional centre.

She directed the police to return the case file to the Director of Public Prosecution for legal advice and subsequently adjourned the matter until October 9 for mention.

Earlier, the Prosecutor, Inspector Oladejo Balogun, told the court that the defendant committed the offence on Tuesday at 2. 00 p.m., at Apete area, Ibadan.

Mr Balogun said that the defendant was in possession of the gun without justification.

The prosecutor said that the offence committed contravened Section 3 of the Robbery and Firearms (Special Provisions) Act, CAP 398, Laws of the Federation of Nigeria, 2004.
